1. General Provisions

1.1. Document status

This document is a public offer for Aperta Network services. By creating an account, paying for a plan, receiving an access key, or otherwise starting to use the service, the Customer accepts this offer and enters into an agreement with the Provider.

1.2. Publication of the offer

The current version of the offer is published at https://aperta-network.com/docs/oferta. If several versions exist, the version published on the website prevails.

1.3. Nature of the agreement

The agreement is concluded by full and unconditional acceptance of these terms. The English text is provided for convenience; if it conflicts with the Russian version, the Russian version prevails.

2. Definitions and Terms

For the purposes of this offer, the following terms apply:

  • Provider means the person operating the Aperta Network service.
  • Customer or User means an individual who accepts this offer and uses the service.
  • Service means the Aperta Network website, applications, bots, servers, and related technical infrastructure used to provide encrypted network access.
  • Account means a protected user record used to manage access, subscription status, and service settings.
  • Plan means a predefined service package with a specific term, available locations, number of simultaneous devices, and other parameters.
  • Subscription means paid access to the service for a selected period.
  • Payment agent means a third party authorized to process payments.

3. Subject of the Agreement

3.1. Service description

The Provider gives the Customer remote access to Aperta Network infrastructure for encrypted transmission of network traffic. The service is provided as a technical tool and does not transfer ownership of software, servers, or network resources to the Customer.

3.2. Scope of service

The exact scope of the service, including available locations, connection limits, speed, subscription period, and other parameters, is determined by the selected plan and information published on the website or in the service interface.

3.3. Technical limitations

The Customer understands that connection quality may depend on device settings, internet provider restrictions, network load, routing, third-party platforms, and other factors outside the Provider's direct control.

4. Agreement Acceptance Procedure

The Customer accepts the agreement by registering, paying for a plan, requesting or receiving configuration data, clicking an acceptance button, or starting actual use of the service. Acceptance confirms that the Customer has read and agrees to these terms.

5. Provider Rights and Obligations

The Provider undertakes to provide access to the service within the selected plan, maintain the technical operation of the infrastructure, and process support requests within a reasonable time.

The Provider may change server addresses, locations, protocols, configuration parameters, prices for future periods, and the list of available functions. The Provider may suspend or restrict access to protect the service, prevent abuse, comply with legal requirements, or perform maintenance.

6. Customer Rights and Obligations

The Customer may use the service within the selected plan, receive support, and request information about the service. The Customer must provide accurate information where required, keep access keys confidential, pay for selected plans, and use the service lawfully.

The Customer must not use the service for spam, fraud, attacks, malware distribution, unauthorized access, copyright infringement, or any activity prohibited by applicable law.

7. Plans, Fees, and Payment

Prices, plan parameters, and payment methods are published on the website or in the service interface. Access is activated after successful payment unless another procedure is stated. Fees already paid are not recalculated for a past or current period unless required by law or explicitly stated by the Provider.

Payment may be processed by third-party payment agents. The Provider is not responsible for failures caused by a payment agent, bank, payment system, or incorrect payment details provided by the Customer.

8. Term and Termination

The agreement takes effect upon acceptance and remains valid for the duration of the selected subscription unless terminated earlier. Access may end automatically when the paid period expires.

The Provider may terminate or suspend access if the Customer breaches these terms, attempts to abuse the service, creates security risks, or uses the service unlawfully. The Customer may stop using the service at any time.

9. Liability of the Parties

Each party is liable for breach of its obligations under applicable law. The service is provided on an as-is and as-available basis to the extent permitted by law.

The Provider is not liable for losses caused by third-party networks, internet providers, device misconfiguration, blocking or filtering systems, force majeure events, actions of public authorities, or the Customer's unlawful use of the service.

The Provider's maximum liability is limited to the amount paid by the Customer for the most recent paid service period, unless a mandatory rule of law requires otherwise.

10. Service Features

10.1. Compliance with law

Use of the service does not exempt the Customer from complying with applicable law.

10.2. Not intended for unlawful circumvention

The service is not intended for illegal circumvention of access restrictions or for committing unlawful acts. The Customer is solely responsible for how the service is used.

10.3. Technical changes

The Provider may change IP addresses, server locations, routing, protocols, encryption parameters, and available servers without prior notice where needed for operation, security, or maintenance.

10.4. No absolute anonymity

The service improves connection privacy but does not guarantee absolute anonymity or protection against all technical, legal, or operational risks.

11. Personal Data

Personal data is processed according to the Privacy Policy and the Consent to Personal Data Processing published on the website. The Customer should review those documents before using the service.

12. Dispute Resolution

Before going to court, the Customer should send a written claim to support@aperta-network.com with a description of the issue, relevant facts, and preferred resolution. The Provider reviews claims within a reasonable time.

The agreement is governed by the laws of the Russian Federation unless mandatory law provides otherwise.

13. Force Majeure

The Provider is not liable for failure or delay caused by circumstances beyond reasonable control, including natural disasters, war, civil unrest, epidemics, government actions, network failures, provider outages, power failures, sanctions, or other extraordinary events.

14. Changes to the Offer

The Provider may update this offer unilaterally. The new version takes effect after publication on the website unless another effective date is specified. Continued use of the service after publication means acceptance of the updated terms.

16. Miscellaneous

If any provision of this offer is held invalid or unenforceable, the remaining provisions remain in force. Failure to enforce a provision does not waive the right to enforce it later.

This offer, together with the Privacy Policy and related documents referenced in it, forms the entire agreement between the parties regarding the service.

17. Final Provisions
